1. The service
TenderGauge aggregates publicly available tender notices (including TED and UNDP sources) and produces AI-assisted fit scores and eligibility checks against the supplier profile you provide. TenderGauge is a service operated by Bite and Brand Ltd. These terms form a contract between you (or the company you represent) and Bite and Brand Ltd.
2. Your account
You must provide accurate profile information and keep your login credentials secure. You are responsible for activity under your account. The service is intended for business use and is not offered to consumers.
3. AI scores are advisory only
Fit scores, recommendations, eligibility gaps and summaries are automated estimates provided for guidance only. They are not legal, procurement or professional advice, and we make no guarantee of tender success, shortlisting or award. Tender data is sourced from third parties and may be incomplete, delayed or inaccurate. Always read the original notice and verify deadlines and eligibility requirements before bidding. Any decision to bid is yours alone.
4. Subscriptions and payment
Free accounts include 3 AI analyses per calendar month. Starter (£29/month) includes 20 analyses and Pro (£79/month) includes unlimited analyses, subject to fair use. Prices are in pounds sterling and exclude VAT where applicable. Paid plans renew automatically each month until cancelled, and payments are processed by Stripe.
5. Cancellation and refunds
You can cancel at any time from the subscription management portal. Cancellation takes effect at the end of the current billing period; your account then reverts to the Free plan. Part-months are not refunded except where required by law. We may suspend or terminate accounts that breach these terms.
6. Acceptable use
You must not scrape, resell or redistribute the service or its output at scale, attempt to circumvent usage quotas, or use the service unlawfully or to infringe third-party rights.
7. Availability
We aim for continuous availability but do not guarantee uninterrupted service. Features may change, and third-party data sources may become unavailable.
8. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited. Subject to that, we are not liable for lost profits, lost contracts, lost bids, loss of goodwill or indirect or consequential loss, and our total liability in any 12-month period is capped at the fees you paid us in that period (or £50 if you are on the Free plan).
9. Intellectual property
We own the service and its software. You own your profile data and retain rights to your assessment outputs for your own bidding purposes.
10. Changes
We may update these terms; material changes will be notified by email or in the app at least 14 days before taking effect.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
